Xarelto Lawsuit Lawyers
The blood thinning medication Xarelto – made by Bayer – may be linked to serious medical complications including uncontrolled bleeding. The potentially fatal side effect has no antidote. Several lawsuits have been filed over the years against the makers of Xarelto in cities like yours.
The Xarelto lawsuit plaintiffs allege the pharmaceutical caused them or their family members’ harm and, in some cases, the loss of a loved one. Some of the suits claim that Bayer – the maker of the drug Xarelto – failed to adequately warn them of these potentially fatal side effects and that they produced a faulty product.
As a result, some Xarelto takers may have experienced adverse – and sometimes fatal – side effects, including pulmonary embolism, internal and external uncontrollable bleeding and more. Bayer and Janssen Pharmaceutical (a division of Johnson & Johnson) are said to be at fault in this Xarelto lawsuit.
Have you or someone you love experienced complications as a result of taking Xarelto? You may be entitled to compensation. Call 1 (855) 862-4652 to speak to someone about your case today.
Why Lawsuits Against Xarelto Have Been Filed
Many of those affected adversely by the use of Xarelto say that the manufacturers and marketers put their own profits before the safety of the public. One of the most dangerous side effects of the drug is uncontrolled bleeding.
Former patients who used Xarelto have filed lawsuits that allege they were not properly warned about the dangers and risks associated with the drug.
Some of the Xarelto suits also allege there was:
- Unexpected spending and financial obligations due to emergency room visits, continuing care and the loss of work wages
- An emotional toll that caused distress from caring for family members and loved ones who suffered the medical complications
- An added burden of funeral expenses because of a death that resulted from the fatal side effects associated with the pharmaceutical
The claimants hope to hold Bayer and Janssen Pharma accountable for what they claim the companies did – knowingly releasing a dangerous pharmaceutical product into the market.
Xarelto Lawsuit MDL
There are over 5000 cases that have been consolidated in the federal multidistrict litigation proceedings.
The lawsuits are being tried before Judge Eldon E. Fallon under MDL-2592. The Judge presides in the state of Louisiana.
Currently the process of discovery is on-going, but the initial bellwether trial dates have been set for Spring 2017. Several defendants and the plaintiffs are exchanging information relevant to the cases and many more filings have taken place in state courts around the United States.
More About Xarelto
The drug Xarelto, approved in 2011 and also known by the name rivaroxaban, is a more recent product than some of the other blood thinning medications on the market.
The drug itself is manufactured by Bayer, but marketed in the United States of America by Johnson & Johnson’s Janssen Pharmaceuticals. The prescription drug generated almost $2 billion in 2015 alone. In the first half of 2016 it was reported to make an additional $567 million.
More About Xarelto Side Effects
There are a wide range of adverse effects possibly associated with this brand of blood thinner – from bleeding problems to strokes, embolysm and more.
Xarelto is reported to have a low therapeutic index – meaning it can be either safe or dangerous at a certain point for a person within a close range.
According to an interview from DrugWatch.com with Ellen Relkin “Someone can be 110 pounds or 200 pounds, old or young [and] with varying kidney functions and get the same dose and have a very different impact. Unlike the traditional blood thinner, Coumadin, where you have monitoring of the drug where the patient gets their blood checked periodically so the doctor can assess whether the levels are appropriate, you don’t do that with Xarelto.”
Other Serious Side Effects
The bleeding complication possibly linked to Xarelto has been publicized well. But among the various issues with Xarelto, som researchers claim, is also a link to wound infections after replacement surgery for a person’s hip or knee. A person, according to some, may be 10 times more likely to experience wound leakage and infection, often requiring additional surgery.

Injuries Caused by Xarelto
Some of the adverse events that others have linked to the taking of the drug include intestinal bleeding, rectal bleeding, brain hemorrhaging and wound infections after knee/hip surgery. Pulmonary embolisms have also been reported.
There are currently lawsuits that accuse the defendants of hiding important and valuable safety information from the public. These wrongful death suits against Xarelto manufacturers also allege that Bayer and Janssen may not have properly tested the drug before releasing it to the public.
Aside from the deaths that some say have been caused, plaintiffs of the Xarelto legal actions claim to have also suffered from serious injuries related to bleeding – from fatal paranchymal hemorrage to brain bleeds.
These instances of injury may have caused both health problems and other hardships – including undue emotional and financial distress. Emergency hospital visits, ongoing treatment and more may have been required for some.
Xarelto Internal Bleeding Lawsuits
The FDA (United States Food and Drug Administration) has reported several thousand events with seriously adverse outcomes linked to the drug Xarelto. Many of these were uncontrolled bleeding events.
Though blood thinner medications are dangerous in general, this particular drug is around the top of a list put out by the ISMP (Institute for Safe Medication Practices).
Furthermore, there is an ISMP list of “high alert medications” and Xarelto is on this list as well. This list includes meds that pose a “heightened risk of causing significant patient harm.”
The lawsuits claim that hundreds of patients have died due to the uncontrolled bleeding caused by Xarelto. It has been reported by some that in 2012 almost three times more people passed away from adverse events related to Xarelto as compared to patients on another drug called Warfarin.
In addition to the uncontrolled internal bleeding the FDA has apparently received reports of dangerous blood clots being caused in people taking the drug. This would be despite the fact that the drug is supposed to help prevent blood clots.

Why People Are Filing Xarelto and Rivaroxaban Lawsuits
Traditional blood thinning medications required a constant adjustment of dosage and careful nutritional planning. Xarelto, on the other hand, has been called a “one size fits all” drug by some. That positive aspect is also what may make it dangerous.
Ellen Relkin, a lawyer and member of the plaintiff’s steering committee, oversees the lawsuit and believes there is a reason Xarelto’s manufacturers have had thousands of legal claims brought forth against them. The plaintiff’s say the warnings associated with Xarelto were not strong enough.
Add to this the claim that many patients did not know there was no bleeding antidote for the drug. The companies involved (Bayer and J&J), the suits claim, promoted the benefits but minimized info about the downsides and potentially fatal consequences of Xarelto.
XARELTO COURT CASES
How Xarelto Litigation Began
In 2014 a woman named Ruth McGowan began the entire thing by filing a lawsuit on behalf of her father, Thomas Dunkley, who had passed away. The complaint stated that the now deceased man took Xarelto to reduce his risk of stroke. After a month or so of use, the suit claims, Dunkley suffered very serious bleeding in his brain. McGowan’s Xarelto suit alleges the companies that made and promoted the drug concealed safety concerns and did not properly test the medication.
Another preliminary Xarelto complaint was filed by Nancy Packard on behalf of her husband, William, who also died. Packard’s husband took the drug for six months for atrial fibrillation and allegedly suffered serious brain bleeds. Though doctors tried to save him, he died due to uncontrollable bleeding. This particular Xarelto lawsuit filing claims the drug makers did not warn patients about the lack of an antidote.
How to Join Xarelto Court Cases in Your State
There have been thousands of Xarelto claims filed in the United States. This has prompted the U.S. Judicial Panel on Multidistrict Litigation to consolidate the various cases into an MDL in Louisiana and mass-tort in Philadelphia.
There were 4,579 cases before the presiding judge by April 15, 2016 with thousands more likely to be filed in the months following. There are still people affected by the drug coming forward, and if you or a loved one has experienced serious complications linked to the use of Xarelto, you may be entitled to compensation.

Xarelto Class Action Lawsuits
Currently all of the thousands of lawsuits for xarelto are being treated as individual cases. As such, there is not yet a xarelto class action lawsuit.
In lieu of the class action lawsuit against xarelto, the individual cases have been consolidated into a multidistrict litigation, or MDL. A Xarelto class action suit would only have a single plaintiff who represented all others in the class.
Typically class action lawsuits for Xarelto and other class action legal filings would have smaller awards, as people opt to join the class and the award amount gets split among those who take part. Many class action suits also do not involve serious injuries.
Why a Xarelto MDL?
The reason the various cases were consolidated into MDL-2592 was because it simplifies the legal process. The cases are all handled by the same judge in the same court, who now has experience in the matter.
This does not mean you’ll have to give up your own Xarelto lawyer or Xarelto attorney. You may retain your own Xarelto law suit legal representative and your case should be handled as an individual case.
Xarelto Lawsuit Settlement Amounts
At the time of this writing, Xarelto litigation is underway and the defendants (Bayer and Johnson & Johnson) have not yet offered any settlement amount. If the parties involved in this suit do not agree on terms then the trial itself will move forward. Currently bellwether trials are scheduled for early-mid 2017.
It is impossible to guess at what amount may be offered or awarded to the plaintiffs in the Xarelto court cases. Several factors are taken into account when compensation numbers are calculated. These include medical and funeral expenses, loss of companionship, financial damage, loss of quality of life and wages, injuries suffered and future earning abilities.
Once a settlement has been reached or another outcome determined, we will do our best to update you on this site.
